Genesis Financial Management, Inc. (GFM) is fully committed to complying with all applicable laws whether at the state, federal or local level.  We demonstrate our devotion to the highest quality of service by our compliance with these laws.  While often similar, state laws do vary from state to state.  GFM offers its services only in those states in which it is qualified to do business and all services may not be available in all states.  We appreciate the confidence and trust shown by our clients and their creditors; we continually update our services and practices to comply with new regulations or changes in existing law.  GFM employs industry best practices in order to provide consistent, quality service to all clients. 

Security:
We know the security of your account information is of paramount importance to you.  That’s why we follow procedural, electronic and physical security measures to keep your information safe.  Our employees are trained in the proper handling of personal information.
               
Privacy:
GFM values the privacy of clients, consumers, creditors and other parties that may associate with us.  We wish for you to have a clear understanding of the information we may collect and how that information may be used.

Best Practices

Genesis Financial Management, Inc. (GFM) follows these "Best Practices" to ensure integrity, fairness and professionalism in the delivery of services. Limits provided are provided as acceptable upper limits; minimums may vary.

CLIENT/CREDITOR ACCEPTANCE - Debt Management Plans (DMP) should be established only when they are appropriate and advantageous to the client. No client will be refused a DMP for minimum outstanding debt. No creditor will be excluded from the DMP unless it is beneficial to the client.

CERTIFICATION - Counselors shall become certified by a nationally recognized third party agency within 12 months of their hire date. Service shall be provided by certified counselors in accordance with state guidelines.

DISBURSEMENT OF FUNDS - Client funds received for a DMP must be disbursed to the creditors no later than 15 days from receipt of valid funds, or by scheduled disbursement date, whichever is greater.

TRANSMITTAL OF FUNDS - Electronic payment processing is used in remitting funds to creditors whenever possible.

INCEPTION DATES - A client's first disbursement must be received within 90 days of agreeing to service. Proposals must be issued in a timely manner, but no later than the first payment date. Clients will receive a copy of the Best Practices no later than their first payment date where required.

COMPLAINTS - All complaints shall be researched and responded to within 5 business days of receipt of complaint.

ADDITONAL SERVICES - A DMP client may enroll in additional services, if offered. No client will be required to use these services.

FEES - A maximum of $75 shall be charged for establishing a Debt Management Plan. The maximum monthly maintenance fee is $50.

INCENTIVES - Financial incentives or additional counselor compensation should not be based on the outcome of counseling sessions.

REFERRALS - Payments will not be made to consumers or third parties for the referral of new clients to the agency.

COUNSELING – Appointments for a counseling session should be scheduled within 2 business days of receipt of the request.

Privacy Policy

We at Genesis Financial Management, Inc. (GFM) want to be sure that you receive superior service and quality products. We also are concerned about the privacy of your personal information. This notice is to help you understand how we may collect nonpublic personal information about you, the type of information we may collect, and what information we may disclose about you. The same rules apply to former customers as apply to current customers. When we use the terms "nonpublic personal information," we mean personally identifiable financial information that is not publicly available.

Information We Collect
We collect nonpublic personal information about you directly from you and from other sources, including the following;

  • Information we receive from you on applications or other forms or over the Internet or telephone, such as your name, address and creditor information
  • Information about your transactions with us or others; and
  • Information we receive from a consumer reporting agency.

Information We Disclose
Sharing Information with Our Affiliates: Unless you tell us not to (called "opt out"), we may share all of the information we collect, as described above, with companies in our corporate family (called "affiliates"). This information may include:

  • Information we obtain from you, such as your income or your liabilities;
  • Information we obtain from a consumer report, such as your credit score or credit history; and
  • Information we obtain to verify representations made by you, such as your open lines of credit.

Our future affiliates may include financial service providers, such as other non-profit credit counseling agencies. We may have additional affiliates in the future.

Sharing Information with Nonaffiliated Third Parties: Unless you tell us not to (called "opt out"), we may share all of the information we collect, as described above, with nonaffiliated companies outside our corporate family. We will share this information when we believe these other companies are able to extend services or products that might be of value to you. These other companies may be financial service providers (such as insurance agents) or they may be non-financial companies (such as retailers or direct marketers).

We also may disclose any nonpublic personal information to anyone as permitted by law. For example, we disclose information about you to third parties with your consent or at your direction or if disclosure is necessary to effect, administer, or enforce your transaction with us.

In addition, we may disclose all of the information we collect, as described above, to companies that perform services and functions, including marketing services, on our behalf and we may disclose some of this information to other financial institutions with whom we have joint marketing agreements.

Protection of Your Information
We restrict access to nonpublic personal information about you to those employees who need to know that information to provide products or services to you or on your behalf. We maintain physical, electronic, and procedural safeguards that comply with federal regulations to guard your nonpublic personal information.

How to Opt Out (Direct Us Not to Share Certain Information)
Opt Out for Nonaffiliated Third Parties:  If you prefer that we not share information with companies outside our corporate family, you may direct us not to share information by calling us toll free at 1.800.460.8641.  An “opt out” by one consumer will be treated as an opt out for all joint consumers for the same the product, account, or service you have with us.  Note: Even if you direct us not to share information with companies outside our corporate family, we may disclose nonpublic personal information as permitted by law and to companies that perform services and functions, including marketing services, on our behalf. We also may disclose some of this information to other financial institutions with whom we have joint marketing agreements.

“Opt Out” for Affiliates: If you prefer that we not share information with our corporate affiliates, you may direct us not to share information by calling us toll free at 1.800.460.8641. An “opt out” by one consumer will be treated as an “opt out” for all joint consumers for the same product, account, or service you have with us. Note: Even if you direct us not to share information with our affiliates, we may still share with our affiliate’s information about our direct experiences and transactions with you as permitted by law.

Policy Change
We reserve the right to change our privacy policy and this privacy notice from time to time without prior notice to you, unless prior notice is required by law.
